Gender Discrimination in Employment
This refers to gender discrimination taking place in the workplace. Some of the common examples of workplace discrimination are:
- Not being hired due to your gender;
- Being held to higher or different positions or getting evaluated more strictly;
- Being paid less than an individual who is of the other gender that might be equally or less qualified than you;
- Being denied a deserved promotion due to your gender;
- Being subject to unwanted physical advances.
Gender discrimination can happen at any place but it has worse effects at the workplace. Generally, there are three types of gender discrimination in the workplace:
- Implicit biases;
- Sexual harassment or assault.
Sexism can be regarded as a way of gender discrimination in which unjust treatment is done to an employee based on their gender. Women might experience this discrimination through discriminatory hiring, restrictions of benefits or promotions, and violation of any term or conditions of employment on being a woman.
Implicit biases are a less open form of discrimination that generally occurs in the form of stereotypes about the roles of males and females in the workplace. Often, male employees are given preference in promotions or new projects.
Sexual harassment is a very serious form of gender discrimination. Some of the common examples of sexual harassment are inappropriate sexual jokes and non-consensual touching.
Pregnancy Discrimination in Employment
Under this concept, employees are not entitled to discriminate against a female employee based on pregnancy. This discrimination involves treating female employees unfavorably because of pregnancy, childbirth, or any other medical condition.
Under the Pregnancy Discrimination Act, it mentions that employers are not allowed to discriminate female employees based on pregnancy by taking adverse actions such as termination or demotion. All employers must provide female employees with various types of pregnancy benefits and health insurance.
Gender Discrimination in Education
In the US an institution may be held legally responsible if it is proven that they have ignored harassment. Harassment can occur at school or off-campus while the harasser can be a teacher, employee, or student.
To check that institutions comply with the law, one of the following three assessments can be performed:
- Provide equal participation opportunities to both male and female proportional to their enrollment of full-time students. No institution is allowed to make bias decisions based on the sex of the student.
- Show history and also enable the continuous practice of expanding the program for the underrepresented sex.
- Institutions must fully and effectively encourage the interest and abilities of the underrepresented sex.
Equal Pay Discrimination
The Equal Pay Act of 1963 clearly states and protects men and women who are performing the same kind of job from sex-based wage discrimination. Many workplaces pay less to women employees for the same work their male counterparts do. Organizations may be charged on grounds of gender discrimination.
An individual who has been discriminated against on the grounds of the Equal Pay Act may go directly to court and is not required to file an EEOC charge.
